Our colleague Almudena Álvarez attended the 66th annual congress of UIA (International Association of Lawyers) which took place in October in Dakar (Senegal). She had the pleasure of being a speaker in the panel "Disruptive Technologies in Employment and Employment Law – Legal Tech and Artificial Intelligence" where she mainly spoke about the legal issues arisen from having employees in the Metaverse.

Our colleagues Beatriz Sánchez and Almudena Álvarez attended last week the Annual Labour Law Conference of the International Association of Young Lawyers (AIJA) in beautiful Amsterdam! Almudena Álvarez moderated the panel "Employee. Private Life as a Private Matter? How in an out of office private activities may affect the employment" where interesting discussions, among others, about posting on social media and its effects on the employment arose. Our colleague Almudena Álvarez attended last week the Half-Year Conference of AIJA - International Association of Young Lawyers - which took place in Gothenburg (Sweden). More than 300 lawyers from all around the world attended the fantastic academic program (among others, we had very interesting discussions on the post-pandemic teleworking and gig economy).

Post-Contractual Non-Compete Clauses

A post-contractual non-compete clause that provides the possibility for the company not to apply it when the contract is terminated or within a few days after its termination, is a valid clause because i) its enforcement is not being left to the discretion of one of the contracting parties (art. 1256 of the Spanish Civil Code); the company is choosing the option not to apply it in accordance with the contract (furthermore it is reasonable that the company decides to do so, at the time of termination on the basis of the commercial damage that the employee's further activity could cause to the company at that time) and ii) it is not abusive because the employee also voluntarily left the company. Appellate Court of Madrid 25/4/2022.
