Our colleagues Nuria Naranjo, Lidia Lérida, and Almudena Álvarez had the opportunity to participate as speakers in a training session organized by our firm together with the German Chamber of Commerce for Spain (AHK Spanien) in Madrid. During the session, we covered topics such as prior hearings, additional compensations in terminations, termination of employment due to permanent disability, new protections against dismissals without cause or with formal errors, among others. Contract termination due to permanent sick leave

On May 1, International Workers’ Day, the Law 2/2025 of April 29 on termination of the employment contract of employees for permanent sick leave entered into force: The employee shall communicate in writing to the Company whether they wish to maintain their employment relationship within 10 calendar days from the notification of the decision declaring the permanent disability. From that moment, the Company has 3 months to make the reasonable adjustments to the job position or to offer the employee a change of their job position in accordance with their professional profile and suitable to their permanent disability. If the adjustment involves an excessive burden for the Company, there is no other suitable existing position, or if existing, the employee does not accept to change their job position, the Company may terminate their contract by a reasoned written communication, without compensation. For a maximum period of 3 months, the employment relationship will remain suspended. When is the adjustment to be made considered an "excessive burden" for the Company? In companies with less than 25 employees: when the adjustment cost, without taking into account any public aid/subsidies that it may receive, exceeds the highest of the following amounts: a) severance compensation for unfair termination (33 days of salary per year of service) or b) 6 months of salary. In all other companies, the adjustment cost shall be assessed in relation to a) the size of the Company, b) its economic means, c) its economic situation and, d) its total turnover. The burden will not be considered excessive when it is sufficiently compensated by public aid/subsidies. This will be decided by a judge.

Our colleague Almudena Álvarez participated as a speaker in a CLE-accredited legal training for attorneys from New York State, organized by the Queens County Women's Bar Association held last week in Lisbon. The course, "Gender Discrimination at Work: An EU Perspective," explored key topics such as "equal pay for equal work or work of equal value" and its link to Title VII of the Civil Rights Act of 1964. She also had the incredible opportunity to visit the Supremo Tribunal de Justiça of Portugal. Obrigadas very much to our Portuguese colleagues from Paramount Legal for the invitation and for co-organizing this inspiring event!

Our colleague Almudena Álvarez attended last week the Annual IBA Employment and Diversity Law Conference held in colorful Marrakech. Almost 500 employment and labor lawyers from all around the globe gathered in Morocco to network and discuss the last trends on employment law. One of the clear hot topics was of course related to Diversity, Equity and Inclusion. Amazing and brave panelists analyzed the current situation in the US and its international impact under the title: “is DEI officially dead?” We will definitely come back, many thanks International Bar Association!

This week our colleagues Nuria Naranjo and Almudena Álvarez attended the Spring Meeting of ELLINT: Employment & Labor Lawyers International in welcoming Dublin. Besides discussing the goals of the organization for the upcoming months, our colleagues had the opportunity to attend 2 excellent presentations about i) Pay Transparency (led by Mette Klingsten from Mette Klingsten Advokatpartnerselskab​) and ii) Internal Investigations (led by Marijke Granier-Guillemarre from MGG LEGAL​). As the Ha' Penny Bridge, ELLINT connects employment lawyers from 21 jurisdictions to make the life our international clients easier.
